An Anton Piller order is a civil search order to “permit seizure” and is obtained ex parte before a judge in chambers to prevent a defendant from doing away with or destroying the evidence subject to the order, which is sought for the purposes of a dispute and which would in all probability be lost or destroyed if notice were given to the defendant.
This remedy, which in many cases offers obvious advantages for obtaining the evidence necessary for a case and its subsequent procedures, is unlike any other. A Norwich order authorizes a third party to communicate private information without the knowledge of the persons or entities concerned, or to disclose the identity of the perpetrator of alleged harm. The purpose of this order is to allow the victim of a fraud to recover and track sums that would otherwise have been stolen or diverted.
